Terms and Conditions for CPI-Georgia Corp.

These Terms and Conditions ("Terms") govern your use of the services provided by CPI-Georgia Corp. ("we," "us," or "our"), located in Peachtree Corners, Georgia. By scheduling or engaging our services, you agree to be bound by these Terms. Please read them carefully.
1. Description of Services
We provide professional property inspection services for real estate properties. Our services typically include visual, non-invasive examinations of readily accessible components such as the structural components, exterior, roofing, plumbing, electrical systems, heating and cooling systems, insulation, and interior. Our aim is to provide observations and objective assessment of the property's condition at the time of the inspection.
2. Scope and Limitations of Inspection

Standards of Practice: Our Standard Home Inspections are performed using the Standards of Practice of the International Association of Certified Home Inspectors (interNACHI).

Visual and Non-Invasive: Our inspections are visual and non-invasive. We do not dismantle components, move furniture, or engage in destructive testing to access concealed areas.

Limitations on Scope: We do not inspect areas that are not readily accessible, are obstructed, or pose safety hazards. This includes, but is not limited to, areas behind walls, under floors, inside sealed systems, or areas requiring specialized equipment to access.

Exclusions: Unless specified in our written scope of ancillary services, our inspection reports exclude, but not limited to, the following exclusions:

Determining the presence or absence of hazardous vegetation (e.g. poison ivy, poison oak, poison sumac), pests (e.g., termites, insects, arachnids, rodents, snakes, bats, insects and/or, other destructive or hazardous pests.

Assessing environmental hazards such as mold, asbestos, radon, lead-based paint, or volatile organic compounds (VOCs), air quality, dirty power, harmonics, EMF (electromagnetic radiation), water quality and/or other property hazards that are excluded in the InterNACHI Standards of Practice,

Identifying code violations, zoning issues, property value, insurability, or compliance with local ordinances, Local, State or Federal Environmental (EPA) compliance, compliance with Americans with Disabilities Act (ADA) requirements, OSHA compliance and/or other local, state and federal laws or codes.

Inspecting private water or sewage systems (e.g., ponds, lakes, retention ponds, detention ponds, wells, septic tanks), underground utilities, or swimming pools, hot tubs, spas, saunas and their related equipment.

The condition or adequacy of interior security systems, intercoms, low-voltage wiring, or telecommunications equipment, wine cellars, cigar humidors, irrigation systems, exterior lighting, exterior security systems, clothes washers, clothes dryer, whole house fan systems, attic fans, attic powered vents, central vacuum systems and complex or programmable appliances.

3. Client Responsibilities

Access to Property: You are responsible for ensuring that all areas of the property to be inspected are readily accessible, safe, and that all utilities (e.g., water, electricity, gas) are turned on at the property; and any/all supply valves, outlets, switches, breakers are on at the time of the inspection. Delays or inability to access areas due to obstructions or turned-off utilities may result in an incomplete inspection, rescheduling and additional re-inspection fees to return to the property.

Presence at Inspection: While not mandatory, we encourage you or your authorized representative to be present during the inspection to observe the process and ask questions directly. However, for safety reasons and to allow the inspector to focus, direct interference with the inspection process is not permitted.

Review of Report: You agree to carefully review the entire inspection report, including all limitations, exclusions, and recommendations. Any questions or concerns regarding the report should be communicated to Certified Property Inspectors in writing promptly within 7 days of receiving the report.

Independent Verification: The inspection report is limited to observations and opinions by a certified inspector (generalist). You are strongly encouraged to obtain further evaluations, estimates, or repairs from qualified, licensed contractors (or specialists) for any concerns or significant issues identified in the report before making any purchasing decisions.
4. Inspection Report and Reliance

Delivery: The inspection report will typically be delivered to you electronically via email within the same business day after the completion of the on-site inspection.

Sole Use: The inspection report is prepared exclusively for your personal use and benefit. It is based on the inspectors observations during the inspection and information available at that time.

No Third-Party Reliance: The report should not be relied upon by any third party (e.g., sellers, lenders, other buyers) without our express written consent. Any unauthorized use or reliance by third parties is at their own risk, and CPI-Georgia Corp. disclaims all liability for such use.

Accuracy: We strive for accuracy in our reports; however, errors or omissions may occur. Our liability for such is limited as described in Section 6.
5. Fees and Payment

Pricing: Our inspection fees are quoted and agreed upon prior to scheduling the inspection.

Payment Terms: Payment for all services is due in full prior to the dispatch of the inspector to the property, unless alternative arrangements have been agreed upon in writing. We accept major bank cards, debit cards and Zelle transfers.

Cancellation Policy: If you need to cancel or reschedule an inspection, please notify us at least 24 hours in advance. Cancellations made with less than 24 hours notice are subject to a 15% cancellation fee.

Additional Charges: Additional charges may apply for extended travel distances, re-inspections, or if significant delays occur due to property access issues or property utility issues beyond our control.
6. Limitation of Liability

Maximum Liability: You acknowledge and agree that the maximum aggregate liability of CPI-Georgia Corp., its owners, employees, and agents for any claims, damages, or losses arising out of or related to these Terms, the inspection services, or the inspection report, regardless of the cause of action (including but not limited to breach of contract, negligence, errors, or omissions), shall be limited to two times (2x) the total fee paid by you for the specific inspection services giving rise to the claim.

Exclusion of Consequential Damages: In no event shall CPI-Georgia Corp. be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of use, lost profits, diminished property value, repair or replacement costs for defects not specifically noted in the report, or costs of alternative housing, even if advised of the possibility of such damages.

Assumption of Risk: You understand and agree that a home inspection is a limited visual examination and cannot identify every defect or future condition of a property. By engaging our services, you assume the inherent risks that certain defects, including hidden or latent defects, may not be discovered during the inspection.
7. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms, the services provided by Certified Property Inspectors, or the inspection report shall first be addressed through direct communication between you and CPI-Georgia Corp. If a resolution cannot be reached through good faith negotiation, the parties agree to consider non-binding mediation in Cherokee County, Georgia, facilitated by a mutually agreeable mediator.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Cherokee County, Georgia.
9. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
10. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and SMS Communication Policy (if applicable), constitute the entire agreement between you and CPI-Georgia Corp. regarding the services provided, superseding all prior discussions, negotiations, understandings, and agreements, whether written or oral.
11. Amendments
We reserve the right to amend or update these Terms and Conditions at any time. The "Last Updated" date at the top of this page will indicate when the most recent changes were made. Any changes will become effective immediately upon posting the revised Terms on our website. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.
